Save time finding cases that have discussed or interpreted specific sections of a statute or regulation.

QuickCITETM Legislation Citator records contain the summary of judicial considerations, along with treatment, pinpoint reference, case name, citation, court, date, and signal information. Users can link to the full text of the cases within the records. As well, a hyperlink to the QuickCITE section allows users to retrieve the current version and, where available, select to display in English or French.

Purpose of QuickCITE Legislation Citator
The purpose of the QuickCITE Legislation Citator is to allow a researcher:

  • To confirm the authority of legislation
  • To find a way into case law dealing with legislation of interest
  • To determine what sort of judicial treatment the cited legislation receives from the citing cases

You may use the QuickCITE Legislation Citator in several ways:

  • When in the QuickCITE Legislation Citator, search by legislation title and legislation section/article or by citation.
  • When in the QuickCITE Legislation Citator, search by treatment term in the general search term box.
  • When searching other Quicklaw® Current Consolidation Statute sources, link to the QuickCITE Legislation Citator record while viewing a specific section by clicking the at the top of the screen, where available. The QuickCITE Legislation Citator record for that section will be displayed.
  • If you know the legislation citation (e.g., R.S.C. 1985, c. C-46, s. 1), use Note up with QuickCITE on the General Search tab.

Scope of Coverage

  • All English case references (including Federal) from 1992 to present.
  • All Quebec cases from 2006 to present
  • Selected English jurisdiction cases prior to 1992
  • Selected Quebec cases prior to 2006
  • Regulation references for the following jurisdictions (within years indicated above): Alberta, Ontario, Manitoba, Prince Edward Island, Newfoundland, Saskatchewan
  • English and French where available

Summary of Judicial Consideration

A summary of judicial consideration is provided with treatments and counts.

Treatments
The following terms are used to indicate what sort of judicial treatment a section has received from the citing cases:

  • Unconstitutional - The cited statute section was determined by the court to be unconstitutional.
  • Constitutionality discussed - The constitutionality of the cited statute section is discussed but no final determination is made on the issue of constitutionality by the court.
  • Pursuant to - The action or proceeding was brought pursuant to the cited statute section.
  • Considered - The cited statute section was analyzed or interpreted by the court.
  • Referred to - The cited statute section is referred to by the court with no further discussion.
  • Cited - The statute section has been cited and may contain a stronger judicial treatment.

Order of Citing Cases

Citing cases are listed in the following order by default: Date order, most recent first.

Display Options

Flexible display options are available in QuickCITE Legislation Citator records. Users can sort results by date, jurisdiction, court, pinpoint reference (section and subsection), or treatment letter, or filter results by jurisdiction and court.

Hyperlinks

Hyperlinks have been created between the QuickCITE Legislation Citator record and the following documents:

  • The full text of the current section is activated by clicking the legislative citation link at the top of the record.
  • The full text of the citing case is activated by clicking any of the case citations in the citing cases section of the record.
  • The QuickCITETM Case Citator record of the citing case is activated by clicking the corresponding QuickCITE Case Citator record signal in the citing cases section of the record.

Entering Searches - by Legislation Title

All legislation titles in the QuickCITE Legislation Citator conform to the title as enacted by the respective jurisdictions and include the long title, the short title, or formerly known titles of recently changed Acts. Where the Act is available in English and French, the title in either language may be entered. For example:
Criminal Code
Code criminel

If no specific legislation section/article is entered, all records for that Act will be displayed.

Entering Searches - by Citation

Include all parts to the citation including the abbreviated statute volume, the year, the chapter label, the chapter number, and the whole section. For example:
R.S.C. 1985, c. C-46, s. 2

Exclude the pinpoint section if you wish to display all cited sections. For example:
R.S.C. 1985, c. C-46

Entering Searches - by Legislation Section/Article

When you know the title of the legislation to be searched, you can narrow your results by entering the section/article number of the specific section of interest. Enter whole section numbers only. Do not include subsection numbers or lower hierarchy levels.
